Terms & Conditions

1. Service Definition:

 

Our services involve organizing and coordinating travel packages, acting as an intermediary between the client and service providers (such as hotels, transport companies, and tourist attractions). We do not bear direct responsibility for any accidents or damages that may occur during the trip due to any failure on the part of the service providers.

 

2. Responsibility:

• We provide our services in accordance with the highest standards of quality and professionalism. However, in the event of an accident or damage caused by negligence on our part or by any of the service providers we work with, we accept full responsibility and will compensate the client in accordance with applicable laws.

• We do not bear responsibility for accidents or damages arising from client negligence or illegal or irresponsible actions during the trip.

• In case of an incident or damage resulting from provider negligence (such as transport companies or hotels), the client must directly contact the service provider to file a complaint or request compensation. However, we will offer assistance in resolving any issues that arise during the trip.

 

3. Insurance:

• Travel insurance is mandatory prior to departure. We do not assume responsibility for any damages occurring due to the client’s failure to obtain comprehensive travel insurance covering accidents, injuries, damages, or any other risks during the trip.

• The client is responsible for obtaining appropriate insurance that covers accidents, medical emergencies, flight delays, trip cancellations, and any damages that may occur during the trip.

 

4. Booking and Payment:

• Full payment is required at the time of booking via the website. A booking is considered incomplete unless full payment is made.

• Payments are secured through Stripe, utilizing secure payment methods such as Visa, MasterCard, or American Express to ensure the confidentiality and safety of financial information.

 

5. Cancellation and Refunds:

• Cancellation: Once confirmed and full payment is made, the booking cannot be cancelled except in extraordinary circumstances, such as natural disasters or government-imposed travel restrictions affecting the ability to conduct the trip.

• If the trip is cancelled by us due to extraordinary circumstances, the client will be compensated appropriately. However, no refunds are provided if the client cancels the trip after the booking is confirmed and paid in full.

 

6. Program Modifications:

• We reserve the right to modify or change the travel program based on unforeseen circumstances such as weather changes or other external factors beyond our control. If any significant modifications occur, we will notify the client as soon as possible.

 

7. Liability in Case of Incidents:

• We are committed to providing services with the highest quality standards. If an accident occurs due to our negligence or the negligence of a service provider, we will accept liability and provide compensation in accordance with applicable laws.

• We do not accept liability for accidents resulting from the client’s negligence or illegal or irresponsible actions during the trip.

• If an incident occurs due to negligence from a service provider, the client must directly file a complaint with the provider. However, we will cooperate with the client to assist in resolving any issues that arise.

 

8. Client Rights:

• The client has the right to obtain all necessary details regarding the trip, including accommodations, transport, and attractions, before finalizing the booking.

• The client may file complaints regarding the services provided, but these should be directed to the relevant service provider.

 

9. Final Booking Confirmation:

• After full payment is made, a booking confirmation will be sent to the client via email. This confirmation serves as the final contract and the booking is deemed final and cannot be modified or cancelled except in extraordinary circumstances as outlined in these terms.

 

10. Legal Jurisdiction:

• These terms are governed by the laws of Spain and the European Union concerning consumer protection and traveler rights. In the event of a dispute regarding these terms or the services provided, the competent courts will be located in Malaga, Spain.

 

11. Legal Protection:

• All services provided are in accordance with local and international laws in Spain and the European Union. Any objections by the client will be handled in accordance with Spanish law.

 

12. Legal Registration:

• We are legally registered as an Autónomo in Spain under the tax number NIF: Y9158664D. All services provided are in full compliance with Spanish laws.

 

13. Payment Methods:

• Payments are processed through Stripe, ensuring full protection of financial data. The client can make payments using Visa, MasterCard, or American Express via our website, guaranteeing safe and secure transactions.

 

This version is structured to maintain professionalism and legal clarity, ensuring that the terms and conditions are clear, concise, and in accordance with Spanish and European law.
